After a divorce, you will spend less time with your children. In many cases, you will spend much less time with your children. As a result, some of the hardest issues to resolve in a divorce involve time sharing. However under new legislation, there is now a presumption of equal time sharing.

In divorce proceedings, Florida does not use the words “child custody.” Rather, issues about where children will spend their time are referred to as time sharing. Courts have the ability to determine which parent will have majority time sharing, and which parent will have less time-sharing rights. Equal time sharing is now the statutory norm. In every case, courts will look to the best interests of the child when determining a fair and viable parenting plan. The “best interests” standard can encompass many different factors, including:

  • The ability of each parent to encourage a close parent-child relationship.
  • The division of parental responsibilities once the divorce has taken place.
  • The ability of each parent to determine and act upon the child’s needs.

Florida’s legislature has taken the position that each parent should have meaningful involvement in the lives of his or her children. As a result, courts will rarely award sole parental responsibility.

When determining a time-sharing plan, both parents may find it advantageous to negotiate an agreement. Litigation can be costly. More importantly, litigation will leave many important decisions about your future up to a judge. I can help you seek constructive results in negotiation.
